Bush is pretty hamstrung at the moment, he's got no "political capital"left, Iraq isn't going his way, the republicans in the senate are looking at the polls and thinking about '06 and '08, roberts isn't confirmed yet and the democrats smell blood. and topping all that is New Orleans hanging like a sword of damocles above him.

It isn't going to be easy extremely hard for Bush to get his fantasy court, and it has only gotten worse for him. The republicans might want an easy victory and that means a more acceptable candidate to the democrats (and likely to you as well) and Bush might be forced to comply.
